Use of site and services

• Use any materials in any manner that infringes any Intellectual Property Rights or other rights of any party.
• Disrupt or interfere with the security of, or otherwise cause harm to, the Site, or any services, materials, systems resources, accounts, passwords, servers or networks connected to or accessible through the site or any affiliated or linked sites.
• Transmit unsolicited or bulk communications to any ContentKeeper account holder or to any affiliated e-mail address.
• Post or otherwise submit any software, programs or files that are harmful or disruptive of another's equipment, software or other property, including any corrupted files, time bombs, Trojan horses, viruses and worms.
• Create a false identity for the purpose of misleading others.
• Download any materials posted by another that you know, or reasonably should know, cannot be legally reproduced, distributed, performed or displayed in such manner.
• Disrupt, interfere or inhibit any other user from using and enjoying the site or other affiliated or linked sites, materials or services.
• Breach any guidelines or other applicable codes of conduct to a particular service or material.
• Access or use the site in any manner that could damage, disable, overburden or impair any ContentKeeper server or the network(s) connected to any ContentKeeper server.
• Violate any applicable laws or regulations related to the access to or use of the site, or engage in any activity prohibited by the Terms of Use.
• Post or otherwise submit any topic, name, material or information that is child pornography, defamatory, excessively violent, harassing, inappropriate, indecent, lascivious, lewd, obscene, profane, racist, unlawful, or otherwise objectionable.
• Prepare, compile, use, download or otherwise copy any site user directory or other user or usage information or any portion thereof, or transmit, provide or otherwise distribute (whether or not for a fee) such directory or information to any third party.
• Engage in any chain letters, contests, junk e-mail, pyramid schemes, spamming, surveys or any other duplicative or unsolicited messages (commercial or otherwise).
• Violate the rights of ContentKeeper or any third party (including rights of privacy and publicity) or abuse, defame, harass, stalk or threaten another.
• Market any goods or services for any business purpose (including advertising and making offers to buy or sell goods or services), unless specifically allowed to do so by ContentKeeper.

If you are required to fill in a registration form in order to access materials or services from ContentKeeper Technologies, all required information must be current, complete and accurate.

Protection of Intellectual Property

All ContentKeeper materials are protected by copyrights, trademarks, patents and all other intellectual property rights. Any unauthorized use of such materials may breach such laws and this Terms of Use policy. Except as expressly provided, ContentKeeper Technologies and its suppliers do not grant any use of such materials. You agree not to copy, republish, modify, adapt, create derivative works based on or reverse engineer the site or any portions of the site or materials, except as expressly authorized herein. Additionally you must agree not to use any data mining, robots or similar data gathering or extraction methods in connection with this website and ContentKeeper Materials. No ContentKeeper material is to be used without the express written consent of ContentKeeper Technologies Pty. Ltd.

Use of ContentKeeper Software

All software including materials encompassing a software code, programs, tools, utilities, files and otherwise, and any accompanying documentation that is made accessible through this website is the copyrighted and patented work of ContentKeeper Technologies and partners. Use of such material is governed by the terms of the license agreement included with the software, or terms of use expressly stated on the ContentKeeper website.

Warranties and Disclaimers

While not affecting any non-excludable warranty or guarantee implied by law, ContentKeeper does not give any warranty that materials and services are fit for any particular purpose. This warranty is given in place of all warranties, conditions, terms, undertakings and obligations implied by statute, common law, trade usage, course of dealing or otherwise including warranties or conditions of merchantability, fitness for purpose, satisfactory quality and/or compliance with description, all of which are hereby excluded to the fullest extent permitted by law.

ContentKeeper does not control or accept responsibility for the materials found in this website and specifically disclaims any liability with regard to this site, services and any actions resulting from your use of the site and materials and participation in any services. You acknowledge and agree that ContentKeeper does not control, or accept responsibility for data on the customer site, its retention, backup, integrity or use. The use of this site, services or the downloading and other use of any software and materials is done at your own discretion and risk and with your agreement that you will be solely responsible for any damage that may result from such activities.

ContentKeeper assumes no liability for any computer virus that may be downloaded from this site or connected materials and services.

No advice or information obtained by you from ContentKeeper this site, materials or services shall create any warranty not expressly stated in these terms of use.

Limitation of Liability

ContentKeeper Technologies shall not be held liable in contract or in tort for any loss or damage suffered and consumer's rights are limited to those set out in these Terms and Conditions under statute.

To the extent permitted by law any typographical, clerical or other error or omission in this website, sales literature, quotation, price list, acceptance offer, invoice or other documentation or information issued by ContentKeeper shall be subject to correction without any liability on the part of ContentKeeper, its officers, directors, employees or partners.

Force Majeure

No party shall be liable for any delay in performing any of its obligations under these terms and conditions if such delay is caused by circumstances beyond the reasonable control of the party so delaying, and such party shall be entitled to a reasonable extension of time for the performance of such obligations.

Any service response times stated by ContentKeeper in the service contracts are approximate only, ContentKeeper shall not be held liable for any direct or indirect loss or damage arising from its failure to meet such response times, howsoever occasioned.

Governing Law

Terms of Use shall be governed by and constructed in accordance with the laws of the Australia Capital Territory and shall be subject to the non-exclusive jurisdiction of the courts of the Australian Capital Territory.

If any provision of these Terms of Use is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms of Use and the remainder of the other provisions in question shall not be affected thereby.

Restriction and Termination of Use

ContentKeeper reserves the right to block, restrict, disable, suspend or terminate your access to all or part of this website, at our sole discretion, without any notice or liability to you.
